  1. Introduction:
    We will run through the various requirements and coverage of the Workplace Fairness Act, with a specific focus on creating and implementing a grievance handling process.

     

  2. Workplace Discrimination:
    Deep dive into how the 11 protected characteristics and 5 employment decisions are defined in the act. Understand the scope of discrimination in the workplace, including exceptions to the rule as mandated by the act. 

     

  3. Workplace Harassment:
    Understand and differentiate between the various categories and modes of harassment in the workplace, with clear examples to illustrate their differences.

     

  4. Other Types of  Workplaces Grievances:
    Going beyond workplace discrimination and harassment.
    How to handle other possible types of interpersonal conflict and allegations of unfair performance appraisals.

     

  5. Grievance Investigations:
    A close look at how to realistically run grievance investigations from end to end, includes best tips for:

    • statement documentation

    • questioning techniques

    • procedural fairness

    • maintaining confidentiality 

    • allegation analysis and reporting
       

  6. Decision Making:
    Understand how to make a final decision and consequential next steps on grievances raised, based on the theory of ‘balance of probabilities’ and the concept of a credibility assessment. 

     

  7. Retaliation:
    Learn how to spot retaliation, what to do to prevent it from happening as much as possible and how to deal with retaliatory actions in an effective manner.

     

  8. Interactive Case Studies:
    We have put together actual grievances, across a variety of complexities, which we have personally experienced. These cases will be anonymised and used in the session for discussion within small groups, sharing and impactful learning.

     

  9. Organising a training session for your managers:
    We share tips on how to put together a training session for your managers and leadership team to comply with the act.
